1. Scope and responsibilities
This policy covers purchases of Ajica Pro and optional update renewals through Polar, our merchant of record. Polar is the seller in your purchase and processes refunds. Viacheslav Eniutin, the Ajica Licensor identified in the Terms of Sale, provides the Software licence, helps with requests and handles the corresponding licence rights. This policy supplements the End User Licence Agreement and the Terms of Sale.
Requests are handled under the applicable Polar Buyer Terms, applicable law and payment-network rules. This policy does not remove obligations that either Polar or the Licensor has under applicable law.
2. No separate voluntary refund window
Ajica does not offer an additional fixed, reason-free refund period through this policy. This applies to the original Pro purchase and to each optional update renewal. It does not mean that all purchases are non-refundable or that a refund required by law is discretionary.
The macOS application offers a 14-day Pro trial from its first launch, without payment details, and Community features without a time limit. You may use the Trial to evaluate the product, but using it is not a condition for exercising mandatory consumer rights and does not waive those rights. The Trial does not become a paid purchase or subscription automatically.
3. Mandatory rights and digital delivery
Applicable law may provide rights concerning withdrawal, failure to deliver, defective or non-conforming digital content, or payment disputes. Those rights remain available regardless of our voluntary refund policy or the expiry of the Trial or paid update coverage.
For example, where EU or UK consumer withdrawal rules apply, a distance purchase generally carries a 14-day withdrawal right. For paid digital content supplied without a physical medium, that right may be lost when supply begins only if the applicable legal conditions are met, including prior express consent, acknowledgement of the loss of the right and the required contract confirmation. Accepting this policy or merely receiving a Licence Key is not, by itself, a statement that all those conditions have been fulfilled.
A defect complaint and a change-of-mind withdrawal are different requests. Where mandatory law requires repair, bringing the product into conformity, a price reduction, termination or reimbursement, the relevant remedy is not displaced by the absence of a separate voluntary refund window.
4. How to request help or a refund
Use the contact or support route provided with your Polar receipt or order, or email [email protected]. Include the order number or purchase email address and identify whether the request concerns the original licence or an update renewal. A brief description helps us route the request; it is not a requirement to give a reason where law permits withdrawal without one.
Preferably contact us from the purchase email address. If you cannot access it, explain that so we can arrange proportionate verification. Do not send a full licence key, card number, security code or account password. We handle the personal data in your request as described in the Privacy Policy.
We respond to refund enquiries within five business days and coordinate with Polar where needed. Business days are Monday to Friday in Yerevan time (UTC+4), excluding public holidays and other non-working days in the Republic of Armenia. The period starts on the next business day after we receive your message.
This is a response deadline, not a promise that the refund decision or bank credit will be completed within five days. It does not extend any shorter legal deadline or require you to wait before exercising a statutory right.
5. Processing and payment
Refunds are made through Polar. We can arrange a full or partial refund through Polar, and Polar may also issue one on its own initiative under its terms and payment-network arrangements, for example to prevent a payment dispute. Where a refund is processed, Polar handles the payment and the corresponding tax adjustment.
A full refund returns the amount you paid, including the tax Polar collected. Polar's payment processing fees are not deducted from your refund. Your bank or card issuer's currency conversion may make the credited amount differ in your own currency.
Refunds normally return through the original payment method. Posting times depend on the processor and your bank; applicable legal reimbursement deadlines still apply. If the credit does not appear, contact Polar or us with the order reference so the status can be checked. Refund confirmation is provided by Polar or by us.
6. Effect on licence rights and local data
| Transaction outcome | Effect on Ajica rights |
|---|---|
| Full refund of the original Pro purchase | The paid rights arising from that purchase end. A renewal is an extension of that licence, not a separate base licence; update renewals bought for that licence are refunded as well, as explained in section 7. |
| Refund of only an update renewal | Coverage purchased through that renewal is removed. The original licence and coverage supported by other non-refunded purchases remain, as explained in section 7. |
| Partial refund | A partial refund, for example a price reduction, does not by itself end the licence or remove update coverage. |
| Pending request or payment dispute | A pending request or an open dispute does not by itself end licence rights. If a dispute ends with the full payment returned to you, it has the same effect as a full refund of that purchase. Any other restriction must have grounds under the applicable terms and law. |
An installation can apply changed rights at its next online verification or when its saved verification expires. The EULA explains the separate one-calendar-month UTC verification period. We do not promise immediate disabling of an offline installation. Technical delay does not extend rights that have lawfully ended.
A refund or licence change does not itself delete local projects or data. Community features remain available, although functions requiring Pro may no longer be usable. This policy does not promise that every Pro-created item can be edited or exported using Community features.
7. Update renewal refunds
A renewal is a separate optional one-time purchase of 365 days of update coverage for the same licence. It is not a subscription, a new licence or an additional installation allowance.
Refunding only a renewal removes the coverage acquired through that payment. Coverage is recalculated from the original purchase and the remaining valid renewals under the EULA's renewal rule. It is not necessarily calculated by subtracting 365 days from the last displayed end date where several renewals or gaps are involved.
Releases covered solely by a refunded extension cease to be covered on the basis of that extension. You retain rights to versions covered by the remaining licence entitlements, subject to the EULA and verification requirements.
If the original Pro purchase is fully refunded, renewals bought for that licence can no longer be used. We arrange a refund through Polar of each such renewal that has not already been refunded. You do not need to send a separate request: we do this together with the refund of the original purchase, or promptly after we learn that Polar refunded it or that a dispute returned its payment to you.
8. Discounts and payment disputes
A refund does not restore a used launch-campaign slot or create a personal entitlement to a previous promotional price. A later purchase uses the price then available. This does not reduce a refund required by law, impose a refund penalty or remove a remedy available under mandatory law. The launch campaign is explained in section 3 of the Terms of Sale.
You retain applicable rights to dispute a payment through your card issuer. Contacting us or Polar can help resolve billing problems, but does not replace those rights or suspend their deadlines. A dispute or suspected fraud may lead to proportionate restrictions under the relevant terms and law; a legitimate exercise of consumer rights is not described here as misconduct. If you believe a restriction has been applied to you in error, contact us and a person will review it.
9. Applicable version and contact
Updates to this policy apply prospectively. The policy and applicable purchase terms for an earlier transaction are not retroactively replaced merely because a new text is published. Mandatory rights continue to apply.
For help, email [email protected]. For seller-side payment matters, use the Polar contact route associated with your order or its Buyer Terms.
